Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Savorist application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Savorist reserves the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Description of Service

Savorist is a recipe discovery, curation, and AI-powered cooking assistant available on iOS. Features include recipe browsing and discovery, personal recipe saving and organization, recipe scanning from photos, AI-assisted recipe generation and conversation, cook mode, social recipe importing from URLs, recipe sharing, and curated collections. Certain features require an active paid subscription.

3. Eligibility

You must be at least 13 years of age to use Savorist. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration

You may create an account using Apple Sign In or email authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration.

5. Subscriptions and Billing

Savorist offers auto-renewing subscription plans managed through Apple's App Store. By subscribing, you authorize Apple to charge your iTunes account at the applicable rate on a recurring basis.

Free Trial: If offered, your trial begins upon subscription confirmation. You will not be charged until the trial period ends. You may cancel at any time before the trial expires to avoid being billed.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation: You may manage or cancel your subscription through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a subscription period.

Refunds: All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels in accordance with Apple's refund policy.

6. Recipe Discovery Library

Savorist provides a curated discovery library of recipes for users to browse, explore, and save. This library is compiled and maintained by Savorist and is separate from any content users import or create.

Recipes in the discovery library present factual cooking information — including ingredient lists, quantities, temperatures, timings, and procedural cooking steps — in Savorist's own structured format. All recipe images in the discovery library are original works generated by Savorist using artificial intelligence. Savorist does not copy narrative blog content, personal stories, headnotes, or source photography from third parties for its public recipe presentation.

Savorist does not claim to be the original creator of the underlying culinary concepts, dishes, or cooking techniques presented in the discovery library. Recipes represent commonly known culinary knowledge presented in Savorist's own original format and expression.

7. User Content, Imports, and Sharing

7.1 Ownership

You retain ownership of any content you create, upload, import, or submit through the App, including scanned recipes, custom recipes, photos, and notes ("User Content").

7.2 License to Operate

By submitting User Content, you grant Savorist a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt, display, and transmit your User Content solely as necessary to operate, improve, and provide the Services to you and, where you choose to share content, to the recipients or audiences selected by you.

7.3 Private by Default

All recipes you import, scan, or create are stored in your private recipe journal by default. Savorist does not publish, redistribute, or add user-imported recipes to the public discovery library. Your private recipes are visible only to you unless you explicitly choose to share them.

7.4 User-Directed Sharing

Savorist provides features that allow you to share recipes with other individuals at your discretion. When you choose to share a recipe, you are initiating that distribution. Savorist provides the technology to facilitate sharing but does not select, curate, or control what you choose to share.

By sharing content through the App, you represent and warrant that you have all necessary rights, permissions, and authority to share that content, and that sharing it does not violate any third-party intellectual property rights, privacy rights, or applicable laws.

7.5 Representations

You represent that you have all necessary rights to submit and share User Content and that such content does not infringe or misappropriate any third-party copyright, trademark, trade secret, publicity, privacy, or other proprietary right, and does not violate any applicable law or regulation.

8. AI Features and Data Usage

Savorist uses artificial intelligence to provide recipe extraction, generation, and conversational assistance. AI-generated content is provided for informational purposes and may contain inaccuracies. You should verify nutritional information, allergen details, and cooking safety independently.

By using Savorist, you acknowledge that anonymized usage data and app behavior may be used to improve and train our AI models, unless you opt out via the "Help Improve Savorist AI" toggle in Settings. Opting out does not affect your access to any App features.

We do not use the content of your private recipes, personal notes, or photos for AI training purposes without your explicit consent.

AI features are powered in part by third-party services, including OpenAI. Your use of AI features is also subject to the terms and policies of those providers.

9. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law
• Upload, import, save, share, or transmit any content that infringes or misappropriates any copyright, trademark, trade secret, publicity, privacy, or other proprietary right
• Attempt to reverse-engineer, decompile, or disassemble any portion of the App
• Interfere with or disrupt the integrity or performance of the App
• Circumvent any access controls or security measures
• Use automated tools, bots, or scrapers to access the App or its content
• Upload content that is harmful, offensive, obscene, defamatory, or violates the rights of others
• Impersonate any person or entity or misrepresent your affiliation
• Use the App to systematically collect, aggregate, or redistribute recipe content in violation of third-party rights

10. Copyright Policy and DMCA

10.1 Respect for Intellectual Property

Savorist respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law.

10.2 Filing a DMCA Notice

If you believe that content available through Savorist infringes your copyright, you may submit a written notice to our designated copyright agent containing:

1. Your physical or electronic signature (or the signature of a person authorized to act on your behalf).
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the allegedly infringing material and information reasonably sufficient to allow us to locate it (such as URLs, screenshots, recipe titles, or account details).
4. Your contact information, including your full name, mailing address, telephone number, and email address.
5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

10.3 Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who provided the original DMCA notification.

10.4 Repeat Infringer Policy

Savorist maintains and reasonably implements a policy for terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. Users who repeatedly upload, import, or share content that infringes third-party rights may have their accounts suspended or permanently terminated.

10.5 Content Reporting

If you encounter any content within the App that you believe infringes your rights or the rights of others, you may report it using the "Report Recipe" feature available on any recipe, or by contacting us directly at support@savorist.app.

11. Content Removal

We reserve the right, at any time and in our sole discretion, to review, remove, disable access to, or restrict any content that we believe may violate these Terms, infringe third-party intellectual property rights, or violate applicable law. We may act upon receiving a valid DMCA notice, a report from a user, or upon our own review.

12. Third-Party Services

The App integrates with third-party services including but not limited to Supabase (data storage and authentication), OpenAI (AI processing), RevenueCat (subscription management), and SuperwallKit (paywall presentation). Your use of the App is also subject to the terms and privacy policies of these providers. Savorist is not responsible for the availability, accuracy, or practices of third-party services.

13. Intellectual Property

The App, its design, branding, logos, AI-generated recipe images, original recipe presentations, features, and all associated intellectual property are owned by Savorist and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App except for the limited license to use it in accordance with these Terms.

14. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SAVORIST DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

SAVORIST DOES NOT PROVIDE MEDICAL, NUTRITIONAL, OR DIETARY ADVICE. RECIPES AND NUTRITIONAL INFORMATION ARE FOR INFORMATIONAL PURPOSES ONLY. CONSULT A QUALIFIED PROFESSIONAL BEFORE MAKING DIETARY DECISIONS. ALWAYS CHECK INGREDIENT LABELS FOR ALLERGENS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAVORIST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF SAVORIST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SAVORIST'S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to defend, indemnify, and hold harmless Savorist and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the App, your sharing of content through the App, or your violation of these Terms or any third-party rights.

17. Termination

Savorist may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including for violations of these Terms or our repeat infringer policy. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnification, and limitations of liability.

18. Apple End User License Agreement

This App is licensed, not sold, to you. Your use of the App is also subject to the terms set forth in Apple's Standard End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall govern to the extent of the conflict.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in San Francisco County, California.
